Welcome to BrightPath Solar. These Terms of Service ("Terms") govern your access to and use of the BrightPath Solar website and related services. By using our website or services, you agree to these Terms. If you do not agree, please do not use our website or services.
BrightPath Solar is a DBA of Palmer Roofing Solutions LLC ("Company," "we," "us," or "our").
1. Use of the Website
You may use our website for lawful purposes only. You agree not to:
- Use the website in any way that violates applicable laws or regulations
- Submit false, inaccurate, or misleading information
- Use the website to transmit viruses, malware, or harmful code
- Attempt to access parts of the website you are not authorized to access
- Use automated means (bots, scrapers) to access the website without our written permission
- Interfere with the proper functioning of the website or its security features
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use our services. By using our website, you represent that you meet these requirements.
3. Solar Savings Estimates
Any savings estimates, quotes, or projections provided through our website or by our representatives are estimates only, not guarantees. Actual savings and system performance depend on many factors including but not limited to:
- Your actual energy usage and billing rates
- Utility company policies and net metering programs
- Weather, shading, and roof conditions at your specific property
- Changes in federal, state, and local incentives or tax credits
- Equipment specifications and installation quality
- Future changes in electricity rates and policy
No savings, production, or financial outcome is guaranteed. Any final savings commitment will be provided in a signed contract.
4. Tax Credits and Incentives
Information about federal tax credits (including the Residential Clean Energy Credit), state incentives, utility rebates, and other programs is provided for informational purposes only. Eligibility depends on your individual tax situation and the current version of applicable laws. BrightPath Solar is not a tax advisor. Consult a qualified tax professional before making decisions based on anticipated tax benefits.
5. Financing
If financing is offered, it is provided by third-party lenders, not by BrightPath Solar. Loan terms, interest rates, and approval are determined solely by the lender based on your creditworthiness and other factors. BrightPath Solar does not guarantee approval or specific terms.
6. Contact Consent (TCPA)
By submitting your information through our website, you expressly consent to receive telephone calls and text messages (including via automated technology, pre-recorded messages, and artificial voice) from BrightPath Solar, its affiliates, service partners, and financing partners at the phone number(s) you provide, regarding solar products and related services. Consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text message or asking to be removed verbally during a call.
You may also request to be placed on our internal Do Not Call list by contacting privacy@gobrightpathsolar.com.
7. Intellectual Property
All content on this website — including text, graphics, logos, images, videos, and software — is the property of BrightPath Solar or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
8. User-Submitted Information
You represent and warrant that any information you submit through our website is accurate and that you have the legal right to provide it. You grant BrightPath Solar a non-exclusive, royalty-free license to use submitted information for the purposes described in our Privacy Policy.
9. Third-Party Services and Links
Our website may contain links to third-party websites (including HubSpot scheduling, Meta tracking, and others) and may integrate with third-party services. We are not responsible for the content, privacy practices, or availability of third-party websites. Your use of third-party services is governed by their respective terms.
10. Disclaimer of Warranties
Our website and services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, BrightPath Solar disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the website will be error-free, uninterrupted, or free from viruses.
11. Limitation of Liability
To the fullest extent permitted by law, BrightPath Solar and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
In no event shall our total liability exceed the amount you have paid to BrightPath Solar in the 12 months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless BrightPath Solar, Palmer Roofing Solutions LLC, and their affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the website, violation of these Terms, or infringement of any rights of another party.
13. Arbitration and Dispute Resolution
Any disputes arising from your use of the website or these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. You waive your right to a trial by jury and to participate in a class-action lawsuit.
If any provision of this arbitration clause is found unenforceable, the remainder shall remain in effect. This arbitration provision does not prevent you from filing a complaint with a relevant government agency or from pursuing claims in small claims court where applicable.
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes not subject to arbitration shall be resolved in the courts located in New York State.
15. Termination
We reserve the right to suspend or terminate your access to the website at any time, with or without notice, for any reason, including violation of these Terms.
16. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website after changes are posted constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrightPath Solar regarding your use of the website.
